User Agreement

With “Postive”, you can create, customize and communicate all your messages with ease. We provide our meticulously curated templates perfected for all social media requirements such as WhatsApp, Facebook, Instagram, Twitter and customize design, style, size, and content through over application “Postive” (hereinafter “Service” or “Services”).

You need to sign up for a user account by providing all the required information to access or use the services. By signing up you agrees that;

• You guarantee that any information and other content, such as your profile information is correct, not in violation of applicable law. You are responsible for any activity that occurs through your account;
• You have not opened an account on behalf of third parties;
• You have not created accounts with the service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.;
• You have completed 18 years;
• You will not post violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive photos or other content via our service;
• You also represent that all information you provide or provided to us upon registration and at all other times will be true, accurate, current and complete and you agree to update your information as necessary to maintain its truth and accuracy;
• You agree that you will not solicit, collect or use the login credentials of any other user;
• You will not create posts with a view to defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate people or entities and you must not post private or confidential information through our service;
• You hereby agree that you have not used any other person's credit card information, or alternate numbers, non-public phone numbers or non-public email addresses;
• You are solely responsible for your interactions with other users of the service, whether online or offline;
• You agree that we are not responsible or liable for the conduct of any user;
• We reserve our right, but have no obligation, to monitor or become involved in disputes between you and other users. Exercise common sense and your best judgment when interacting with others, including when you submit or post content or any personal or other information;
• You must not create or submit unwanted comments, likes or other forms of spam communications to other users;
• You must not interfere with or disrupt the service or servers or networks connected to the service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature;
• You must not create :
• Content that promotes or supports terrorism or violent extremism includes, but may not be limited to :
• Glorifying or praising violent extremist groups or their members;
• Coordinating, promoting, threatening, or praising an act of violence by or on behalf of violent extremist groups or their members;
• Providing instructions or instructional materials to commit an act of violent extremism;
• Soliciting an individual or group to finance, undertake an act of violent extremism, or become involved in the activities of a violene extremist group;
• Content that incites violence or hatred towards a person or group of people based on race, religion, gender identity or expression, sex, ethnicity, nationality, sexual orientation, veteran status, age, disability or other characteristics associated with systemic discrimination or marginalization includes, but may not be limited to :
• Content that illicitly promotes the sale of regulated or illegal goods includes, but may not be limited to :
• Selling illegal firearms or firearm parts;
• Selling illegal drugs;
• Selling endangered species or products derived from endangered species;
• Content that illicitly promotes the sale of regulated or illegal goods includes, but may not be limited to :
• Visual depictions of a minor engaged in a sexual act or lascivious depictions of a nude minor;
• Encouraging or promoting sexual attraction by adults towards minors;
• Promoting, normalizing, or glorifying child grooming behaviors;
• Content that impersonates others in order to deceive includes, but may not be limited to :
• Replicating the same name, image, and/or description as another existing creator;
• Posing as another person, brand, or organization in a misleading manner;
• Sensitive Content : Content that promotes graphic or gratuitous depictions of violence, gore, or other shocking imagery includes, but may not be limited to :
• Severely mutilated or dismembered bodies;
• Promoting animal cruelty or torture;

Subject to your compliance with these terms at all times, we grant you a personal, non-exclusive, non-transferable and limited right to use the services for your own personal, non-commercial use. You are not allowed to use our services on any device that you do not own or control. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Postive applications, any updates, or any part thereof.

You are not granted any right to use Postive name, trademarks or other commercial symbols. All rights not expressly granted to you under these terms shall be retained by Postive.

Postive makes every effort to provide adequate and efficient technical support, upgrades and updates for the services. Postive shall, however, not be under any obligation to provide support or maintenance for the services under these terms and reserves the right to limit or discontinue the support, upgrades and updates provided from time to time.

We welcome feedback of any sort and are always interested in learning about ways we can make our services better. If you choose to submit comments, ideas or feedback, you agree that we are free to use them without any restriction or compensation to you. By accepting your submission, we do not waive any rights to use similar or related Feedback previously known to Postive, or developed by its employees, or obtained from sources other than you.

By submitting a complaint regarding your account, you authorize our team to check content on your account as required to address the issue.

If we receive a complaint against you by a third party concerning your activities as part of the use of the services, we will inform you on your contact details provided to us. You must respond to the complainant directly within 7 (Seven) days of receipt of the complaint forwarded by us, failing which, we may disclose your name and contact information to the complainant for enabling the complainant to take legal action against you. Further we may be entitled to discontinue or suspend the account without any demur.

The services may contain links to external content provided by third party services. Such third party content and services may be subject to the respective third party terms and conditions and we will not be liable for any such third party content and services.

The first 07 days are absolutely free. We won’t ask for payment details. After 07 days or during 07 days you can choose any premium plan provided by “Postive”.

After the end of the free trial you may still use the services and create posts with “Postive”, but you will be provided with a watermark on all posts.

Postive offers certain features or services for which a fee will be payable (“Paid Services”). Your purchase of the paid services may be subject to foreign exchange fees or differences in prices based on location. If you purchase or subscribe to such paid services, you agree to pay us the applicable charges “Postive Charges” and taxes in accordance with the applicable third party payment and billing terms, based on the platform you are using, which are incorporated herein by reference. You will be charged the applicable fees and taxes during the subscription period unless you cancel the paid service, in which case you agree to still pay these fees through the end of the applicable subscription period.

We may change the Postive Charges from time to time by posting the changes in or on the services or by notifying you in advance.

All charges are, except as otherwise expressly provided herein or as required by applicable law, non-refundable. Failure to pay these fees may result in suspension or termination of your service or subscription.

Depending on what platform you are using, prepaid fees for the services may be connected to your device as well as its phone number. Therefore, in some cases, if you change the device or its SIM-Card, you cannot transfer the balance to a new device or SIM-Card and no refund will be available in such cases.

Your right to use the services continues until these terms are terminated. We may terminate the terms and your use of the services at any time with thirty (30) days' advance notice. You may terminate the terms at any time by uninstalling the “Postive” application and ceasing the use of the services.

Upon any termination, you agree to cease using the services.

Upon termination by you, or by Postive due to your breach of these terms, you will not be refunded any fees or charges, if any.

Provisions of sections Disclaimer of Warranties, Limitation of Liability, Termination and Governing Law shall survive any termination of these terms.

To the maximum extent permitted by applicable law, you expressly agree that “Postive” or “Code One Zero Technology Private Limited” shall not be liable for any direct, indirect, special, incidental, consequential or exemplary damages, including but not limited to damages for loss of profits, data and goodwill, arising out of the use or inability to use the services or the content.

In particular, and without limitation, Postive or Code One Zero Technology Private Limited shall not have any liability for any information stored or processed within the services, including the costs of recovering such information. Your only right or remedy with respect to any problems or dissatisfaction with the services, is to uninstall the Postive application and cease to use the services.

Any use of the content and information obtained through the use of the services shall be at your own discretion and risk.

Nothing in these terms shall limit or exclude our liability for any liability that mandatorily cannot be limited or excluded by law, including any rights you may have as a consumer under the Consumer Protection Act.

I hereby authorize and give consent to Code One Zero Technologies Pvt. Ltd. to send me, either through itself or through an third party service provider, from time to time various information / alerts / SMS / other messages or calls or commercial communication, and other services on the aforesaid listed telepnone numbers, whether these numbers are registered with National Do Not Call Reastry/ listed in National Customer Preference Register or not. I also contirm that by sending any of such messages / calls, I will not hold Code One Zero Technologies Pvt. Ltd. and its third party service provider liable / institute complaint under the Telecom Commercial Communications Customer Preference (TRAI) Requlations, 2010 or such other applicable regulations including an amendment thereof, as may be applicable from time to time. It will be auto renewed every month and if you want to stop this service please write an email to digital@postit.digital before the due date and also once the amount is debited from account it will not be refunded.

These terms shall be governed and construed in accordance with the laws of India. The courts at Ahmedabad (Rural) alone shall have jurisdiction to try the disputes between you and Postive. You irrevocably submit to the jurisdiction of such courts/tribunals at Ahmedabad (Rural).

Our services can be used through internet connection only. You acknowledge that you are fully responsible for the internet connection and/or mobile charges that you may incur for using our services. Please consult your carrier, mobile operator, etc. for further information.

We may change the services at any time, such as by adding or removing features.

We also reserve our right to modify these terms at any time by providing revised terms to the user or by publishing the revised terms within the services.

The revised terms shall become effective upon such publishing or notification to the user. You will always find the latest version of these terms at www.postive.digital. Any continued use by you of the services following publication or notification of revised terms shall constitute your acceptance to the revised terms.
